What is Domestic and Family Violence?

Domestic and Family Violence Protection Act 2012 (the Act’’’’’)

Under the Domestic and Family Violence Protection Act 2012, the Act is to be administered under the principle that the safety, protection and wellbeing of people who fear or experience domestic violence, including children, are paramount, and people who fear or experience domestic violence, including children, should be treated with respect and disruption to their lives minimized.

 

What is a Relevant Relationship?

Under the Act, a relevant relationship for a protection is an either Intimate Personal Relationship, or a Family relationships, or an informal care relationships.

The types of behavior or abuse that are covered by the act include: Physical or Sexual Abuse, Emotional or psychological Abuse, Economic Abuse, threatening or coercive; or behaviour that in any other way controls or dominates a second person and causes them to fear for their safety or wellbeing or that of someone else.

How we can help?

We assist clients applying for a protection order, including temporary protection orders, representation before the court, varying the terms of or revoking an existing protection order, defending an application for a protection order and in registering an interstate protection order.

Assistance with preparing your affidavit (a sworn statement) including assessing relevant supporting evidence and any evidence from witnesses, representation at the hearing, including submissions to the court, cross-examination and evidence-in-chief. The hearing will take place before a closed court room which means no public is allowed to watch and the proceedings are kept confidential.

What to do if you have been accused of domestic violence?

We can also help if allegations have been made against you that you have been the perpetrator of violence or are subject to a Protection Order. While a Protection Order is a civil order by a court, a breach of a Domestic and Family Violence Protection Order will be a criminal matter and may result in criminal penalties.
